These Terms of Service (“Terms”) govern your access to and use of the Publication, including newsletters, posts, audio/podcast content, images, comments, and any other content or services we make available through the Publication (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1) Relationship to Substack

The Publication is hosted on the Substack platform. Substack provides platform features like email delivery, subscriptions (even if free), commenting, and account tools. Your use of Substack is also governed by Substack’s own terms and policies.

2) Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the consent of a parent or legal guardian.

3) Accounts and Security

Some features (such as commenting or subscribing) may require a Substack account. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

4) Free Access; No Paid Subscriptions (At This Time)

The Publication is currently offered without paid subscriptions. We may introduce paid features in the future, and if we do, we will update these Terms (and any applicable policies) accordingly.

5) Our Content, Accuracy, and Editorial Approach

Send Newz aims to provide truthful information to the best of our knowledge. The writing style may include humor, sarcasm, jokes, and commentary, but it is not intended as satire.

That said:

• We do not guarantee that all content is complete, current, or error-free.

• Mistakes can happen; if you believe something is incorrect, contact us and we may correct or clarify it.

6) No Professional Advice

Content on the Publication is provided for informational and entertainment purposes only. It is not professional advice (legal, medical, financial, or otherwise), and you should not rely on it as such. You are responsible for decisions you make based on the content.

7) Intellectual Property and License

Our content

Unless otherwise noted, Send Newz owns or licenses the content we publish, including text, images, graphics, logos, audio, video, and design (the “Publisher Content”). Publisher Content is protected by copyright and other laws.

Limited license to you

We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

Restrictions

You may not, without our written permission:

• Copy, reproduce, redistribute, republish, sell, or commercially exploit Publisher Content;

• Remove copyright notices or watermarks (if any);

• Systematically scrape or harvest content at scale.

Sharing: Linking to posts is always welcome. Quoting small excerpts with clear attribution and a link is generally okay. Republishing full posts (or substantial portions) is not.

8) User Content (Comments and Community)

If you post comments or other content (“User Content”), you are responsible for what you post.

By submitting User Content, you grant Send Newz and Substack a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that User Content as needed to operate the Services (for example, displaying your comment under a post).

We may remove or restrict User Content at any time for any reason, including if it violates these Terms.

9) Community Standards and Acceptable Use

You agree not to use the Services to:

• Harass, threaten, defame, or abuse others;

• Post hateful or discriminatory content targeting protected groups;

• Post pornography or explicit sexual content;

• Encourage illegal activity or provide instructions for wrongdoing;

• Impersonate others or misrepresent affiliation;

• Spam, distribute malware, or attempt to disrupt the Services;

• Dox people (share private identifying information without consent).

We may moderate, restrict, or terminate access for violations.

10) Copyright Complaints

If you believe content on the Publication infringes your copyright, contact us at the email above with:

• Identification of the copyrighted work;

• Identification of the allegedly infringing material (link);

• Your contact information;

• A statement you have a good-faith belief the use is unauthorized;

• A statement, under penalty of perjury, that your notice is accurate and that you are the rights holder (or authorized agent);

• Your physical or electronic signature.

11) Third-Party Links and Services

The Services may link to third-party websites or services. We do not control them and are not responsible for their content, policies, or practices. Your interactions with third parties are between you and them.

12) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted, error-free, or secure operation of the Services.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEND NEWZ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (WHICHEVER IS GREATER). (Currently, that will generally be $50 since the Publication is free.)

Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the maximum extent allowed.

14) Indemnification

You agree to indemnify and hold harmless Send Newz from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Services, or your violation of these Terms.

15) Termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or if we discontinue the Services. You may stop using the Services at any time.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

16) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify users by posting an update on the Publication or by other reasonable means. Continued use after changes become effective means you accept the updated Terms.

17) Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Los Angeles County, California, and you consent to jurisdiction and venue there.
